Presented byProfessor David Hricik, SummaryE-mail has rapidly become a preferred means of communications among many lawyers and their clients. However, this form of communication is not without new ethical concerns. Can lawyers communicate with clients using e-mail to the extent that a reasonable expectations of confidentiality exists even though, at least theoretically, a third party could view the email while in transit? While it seems settled that sending the email will not waive any privilege subsisting in the contents while the e-mail is in transit there are other questions that arise. Are there jurisdictional issues to be taken into consideration? How should client confidentiality be ensured? What about the case of misdirected email? This program will consider the ethical implications that are raised with this form of communication. CLE Credit: This program was originally approved for live online credit.
